Reporting to the Head of HR Operations, Services & Analytics, the primary responsibility of this position is to ensure South Pole’s legal compliance with regards to all employment-related matters. The Global Employee and Labour Relations Manager will proactively manage and mitigate the Company’s risks globally as it relates to employment law and regulations across all countries in which the company’s workforce operates. The role will collaborate with the HR, Legal and operations team to provide counsel on a wide variety of employment law issues, such as collective bargaining, contracts, policies and HR programs. This position will support general corporate initiatives related to human capital and collaborate closely with the HR, Legal, and Operations teams on key employment initiatives and related global projects.
Main tasks & responsibilities:
- Serve as the primary legal advisor to the company’s Human Resources team, providing labor and employment-related legal advice and counsel on a broad range of employment and labor law issues including but not limited to: remote work, terminations and wrongful discharge, discipline and grievances, reorganizations and workforce reductions, leave and absence management, time and attendance management, compensation plans, harassment and discrimination investigations, whistleblower schemes, fraud and damage caused by employees, torts, etc. in all jurisdictions where South Pole is present
- Engage in a constructive union-management relationship and collective bargaining process, coordinating and acting as a key participant in the collective bargaining process, advising management and working with union officials on the interpretation and application of the collective agreement, and managing the grievance process
- Serve as a subject matter expert in all areas of employment law, and conduct yearly revisions of best practice in employment-related topics and compliance; make recommendations and lead the implementation of corrective measures where gaps are identified
- Create and regularly update a comprehensive compliance/legal matrix related to employment law in all jurisdictions where South Pole operates
- Draft and maintain all employment-related templates, including offer letters, employment contracts, waivers, and separation agreements
- Provide advice to management and human resources on a broad range of employment law issues, such as employee relations issues, disciplinary processes and contentious situations, as well as code of conduct breach
- Act as a liaison between HR, Legal, and the business areas on employee relations issues
- Manage the development and updating of Human Resources policies and Regional Office manuals and ensure a common understanding and interpretation of policies and of the collective agreement. The manager is also responsible for providing legal support for internal investigations concerning potential code of conduct or other violations of internal South Pole policies
- Periodically review, update and roll out clauses, documents or agreements related to confidentiality, non-disclosure, non-compete, non-circumvention, non-solicitation, etc.
- Manage outside counsel as needed, particularly in international jurisdictions, in a cost-effective manner
- Take the lead in setting up employment structures in new countries where South Pole intends to employ staff, including but not limited to working with the Finance and legal teams to establish the legal entity, liaising with external advisors to create new employment contract templates, etc.
- Oversee the contractual processes for staff employed as freelancers or via a third party provider (PEO) and partner with the finance team to identify and assess any legal or tax risks
- Provide inputs to the HR Operations team to ensure time management systems are built in alignment with local employment requirements for each jurisdiction
- Bachelor’s Degree in law
- Relevant employee and labor relations experience within a fast paced, global and matrix companies
- Proven experience in setting up ER/LR globally
- Persuasive and articulate communication in English.
- Dutch, Spanish and other European languages are considered as great assets
